The curious case of Hi-Tech Air Solutions and a SLAPP in the face of experts.

Straightforward Wisconsin has obtained a copy of the court documents showing Hi-Tech Air Solutions LLC has filed a SLAPP suit against Mr. Carl Grimes of Healthy Habitats® LLC

Hi-Tech Air Solutions, a small Oklahoma based business has filed a SLAPP law suit against industry expert Carl Grimes for voicing his opinion that the air reactor technology called “Technosite” has not been completely and accurately tested to prove that this technology can denature mycotoxins without the need for full physical remediation. Hi-Tech Air Solutions, LLC claims that Mr. Grimes has costs the company customers and lost sales due to his professional opinion.

SFW has also learned that a Hi-Tech Air Solutions sales representative gave explicit advice to use the machine in a moldy environment without performing proper remediation.

SFW has also obtained notifications of and verified proof of multiple complaints of worsening and new mold illness related symptoms during the use of the Technosite Air Reactor technology in their homes after purchasing the machines.

SFW has documented material in a case where the CEO Made legal threats against another individual for making statements that the Air Reactor Technology did not work as described.

A SFW reporter had a 22.3 minute phone conversion with the CEO of Hi-Tech Air Solutions questioning whether or not the company planned legal action against Mr. Carl Grimes and the other individual in question. The CEO, a Mr. Ray Robison of Moore Oklahoma stated that he believes “Hi-Tech does have valid claim against Mr. Grimes” when Mr. Robison was asked about whether they planed to litigate against the other individual Mr. Robison replied “No, she doesn’t have any money” In an off the record conversation it was abundantly clear that the CEO of Hi-Tech has 100% full faith and belief in the efficacy of the Technosite Air Reactor technology.

In the approach that SFW always takes in reporting as much factual information as possible, we believe the lawsuit to be unnecessary and that it creates undue burden on Mr. Carl grimes, and the United States Constitution’s 1st amendment right of free speech. We believe any litigation against “opinion” to be defrauding the court system of time, tax payer dollars and stresses an already over worked system. To say that this suit is frivolous would be an understatement.

    In 2015 I suppose we should be able to say “we have seen it all” but there is always some little story, or some small, but glaring matter that shouts “Wait…. What?”

Such is the curios case of Hi-Tech Air Solutions and the people they sue.

    To be helpful, we’ll start with a brief introduction of what exactly a Hi-Tech Air Solutions machine is and why that company would make the decision to litigate against experts in the indoor air quality field.

    Hi-Tech Air Solutions is a small Oklahoma based company, that to best of our knowledge operates out of a house on 39th st in Moore, Oklahoma. They specialize in a technology called Hydroxyl Generation which they call Technosite. Technosite is a proprietary technology to Hi-Tech that is spelled out on their website as follows: “Technosite is a photocatalyst under ultraviolet light. When Technosite® absorbs Ultraviolet (UV) radiation from dual-tube UV-C lamps, it produces pairs of electrons and holes (electron-hole pairs), which are mobile charge carriers carrying negative and positive charge respectively. The hole has strong oxidizing power and the electron has strong reducing power. Technosite® has a very high refractive index meaning the UV-C light shines over a greater area naturally.” (ok, enough with the technical jibber jabber) Long story short, Hi-Tech Air Solutions claims that it’s technology can kill even the most resistant bugs and toxins, or in their words “allergens, mold, bacteria and viruses and many more…”

    Sounds great right!?! Who wouldn’t want one of these machines in their house? This machine is said to clean the air, kill bad germs, viruses, bacteria, and many other nasties in the air you breathe. So who would question such a wonderful product, and why wouldn’t you want one?

We also think it might help to introduce you to the defendant of the curious law suit in question. We give you, Mr. Carl Grimes.

   Here is just a little snippet from his website: “Carl Grimes started Healthy Habitats® LLC in 1987 specifically to address the needs of individuals who were not being satisfactorily helped by conventional methods. He has developed tools to generate the information necessary for individuals to successfully address their indoor exposure complaints.

Mr. Grimes has an intriguing and, at first glance, contradictory position within Indoor Air Quality (IAQ) issues.”

    Seemingly, Mr. Carl Grimes might be a good candidate to research and comment on the efficacy of the new Hi-Tech air reactors, and be fair and impartial about how well these machines might work in removing the mold and mycotoxins from a water damaged building, with the hopes that the building might once again be habitable.

    On top of being a expert in the indoor air quality field, Mr. Grimes spends a good portion of his time helping people who have just found out they are a victim of the mold malady. He offers advice to people who simply just don’t know what to do. The actual science revolving around mold and mycotoxins is still very young, and even the worlds top scientists still don’t have all of the answers, and many in the field still disagree.

    Well, sooner or later it was bound to happen that a company who claims their machine can literally destroy the very toxins Mr. Grimes life’s work has been about and Mr. Grimes him self, crosses paths, and what better place for this to happen then Facebook?

    Hi-Tech Air Solutions LLC were confident they found a way to remediate mold and mycotoxins from indoor air, and they wasted no time getting these machines to market. But, part of that market turned out to be support groups on Facebook, Yahoo and other online groups. The people in these groups tend to be very ill. Many of them have lost their homes and everything they own to mold and mycotoxins. So many people in these groups have spent hundreds of thousands of dollars on snake oils, failed equipment, failed remediation, machines, sprays, bombs, purifiers, chemicals, add infinitum, to no avail. It’s only common sense that this group of suffering people have become skeptical and very careful about what they spend the small amount of money they have left on, and it’s fairly obvious that when a new product comes along claiming to be able to fix their problem they ask the expert in the group his opinion.

    Many in this group turned to Mr. Grimes for help and advice, and as usual they brought this machine to his attention to get his opinion on the matter.

    From what we can find in documents and and what others tell us, his opinion was something along the lines of this: (and we paraphrase) “While Hi Tech machines may very well help people and do what they claim, I have seen no scientific proof that shows Hi Tech Air Machines perform the task of denaturing mycotoxins effectively enough, alone, to make a living environment safe enough for habitation” It is the impression of Straightforward Wisconsin that Mr. Grimes DOES NOT indorse this product.

It should be noted that due to the ongoing litigation Mr. Grimes was unable to answer any questions that we had for him and unavailable for comment.

    So what does a company do when it runs into a critic who’s opinion is that their machine doesn’t do as they claim? Do they submit the machine for testing and prove the critics wrong? Do they allow the critics access to the machine so they can test it and approve it for mold and mycotoxin remediation? Do they perform controlled scientific studies that show it’s undoubted efficacy? No.

    No instead, this particular company has decided it would rather quell the criticism by filing what is refereed to as a SLAPP law suit, and proceed to threaten everyone who dares speak out about the machine and it’s efficacy in treating mold and mycotoxins.

    We were also made aware by another member of these support groups, that she was threatened by the LLC with another separate lawsuit if she continued to express her opinion that the machine did not work as promised.

    Upon initially hearing about this dispute, ( 3/3/2015 ) one of our contributing editors was able to speak with Ray Robison who is the C.E.O. Of Hi Tech Air Solutions LLC.

    Ray was a soft spoken, but passionate conversationalist. He did confirm that his company was considering perusing a SLAPP case against Mr Grimes. He left us with no doubt in our minds that he believes this technology works to denature mycotoxins, he also told us that he has scheduled testing that would prove the efficacy of this machine in regards to denaturing mycotoxins, but as of 4/27/2014 we have been unable to obtain any third party scientific data that proves these claims. As in many cases, passion for the product doesn’t suffice for hard, scientific data that proves a product works as it claims, at least when it comes to forming an opinion.

 As for the other individual who was threatened with a law suite, Ray said “Sue *****? No. She doesn’t have any money”

   SFW also received troubling information from multiple sources that leads us to question if this machine is helpful, or if there is some kind of reaction this machine has with mold that may lead to negative health effects, we were made aware of several different people who commented about things like, shortness of breath, itchy and burning eyes, swollen lymph nodes, swollen and enlarged breasts, headaches, dizziness and fatigue, and bad odors. Obviously these symptoms could be generated by all sorts of things not related to these machines, but these were symptoms observed by multiple sources during exposure to a machine.

SFW was then made aware that there were several individuals that were directing people to purchase the Air Reactor in online supports groups, but did not disclose the fact they were paid sales consultants that sold the machine in question. This type of clandestine operation is very suspect to us.

So what do we think about this machine? What do we think about Hi Tech Air Solutions? Well it’s simple really, we hope they can make this machine do everything they so passionately believe it can do. We hope this machine CAN denature mycotoxins, we hope this machine can kill mold spores, we hope this machine can change the way remediation is done across the world. It would be an impressive accomplishment for a tiny company in rural Oklahoma.

    What else do we think? We think the tests should be done by certified third party specialist, and we think until those results are in, that they should drop this SLAPP case before it costs a legend in the IAQ field everything he owns. We need skeptics, and we need people to differentiate the good from the bad. We need advocates!

  1. It’s my belief on what I have heard about the science of the machines is that they were the same as other hydroxy radical generators that cost far less than these machines. I have read on other hydroxy radical machine sites that the technology is not for use in residential homes in California. This calls into question the safety of the machines and occupied spaces. I have heard from someone who did research on the testimonials that all but one of them were found to be false. Hey I don’t have any money either I’m a mold victim, go ahead and sue me.

  2. Wow what an article!!!! Great accurate info. Sue me too, I am disabled from mold and have no job!!!!!! All the mold people need to stand behind Carl Grimes and give their testimonies about how the machine did not promise what they protested the hopeful hype to be. When people are trying to save their lives and their children’s life spending money on lies is not an option. As a mold community we will share info to save others lives and will report what works and doesn’t work!!!!! Greed is all this company is driven by. They see extremely sick people and an opertunity take what money they have to give them false hope. Wow, this is just evil. Mr Grines has an impeccable history, education, research, and looks out for the people stricken with mold. Fight him and YOU will fight the mold community behind him. The FACTS are in. People sick with mold did NOT get better. That is a fact!!!!! Bring it on. The truth is out. Greed trumps the people who are sick and some have died. You almost sound like monstanto money is more important than people’s lives. Excellent article SFW!!!!

I currently have someone on my mold group saying how well she is since the machine…yet she is suing over a mold lawsuit on her home even though claiming the machine and vitamins have given her life back. Yet online she does not state the name of it. SHE PM’D the info and prices..would cost 5995.oo for a machine large enough to do my home….later offers me a coupon for 5% off…..this is money I can use to get out of this home…..It is so encouraging to hear there could be a machine that cures ally problems ….but I’ve spent way too much on other things and machines that are useless….most of us are sick and broke and lost everything we hAve and Carl Grimes is one of us and has good rights to be skeptical….if this really worked and this owner cared…why would he not make them affordable for people….seems like he wants to sell as many as possible for big ! $$$$ before he goes missing/bankrupt and you are stuck??? I would need to wait to see the science also!!

  4. I agree with Anton: the devices can not possibly cost this much more to manufacture than other similar devices. However, I am about to become a purchaser of one to see if it will help me deal with cross-contamination in a good space from careless bringing in mycotoxin-contaminated products. In normal circumstances I would ozonate, but current circumstances make that solution impossible. If it turns out that living in the space with the machine running in an adjacent space does not improve the living space, I feel relatively confident that Mr. Ray Robison will honor his promise to accept a return of the machine.
    Reading about the law suit against Mr. Grimes, who has helped me in the past with his online comments and his book, is truly an abuse. He did not libel the machine as snake oil; he merely reported the lack of scientific studies (true) and the potential dangers to human health (not yet proven true or false). It seems to me that this is no grounds for a libel suit, but definitely the work of a sleazy lawyer seeking to intimidate potential detractors. It underlines how badly our legal system needs to discourage frivolous lawsuits by requiring plaintiffs to pay all of defendants costs (without exception) if their case is found to be without merit.

I’m curious to hear an update, as I am considering whether to buy one to treat my home, since we tried a traditional remediation but I am still reacting. I have CIRS and cannot be in the house without getting headache, body aches, and fatigue and brain fog.
